Jorge Raoul Garcia Granados de Garay (Granados) appeals from a summary judgment granted in favor of Hibernia National Bank (Hibernia) on Hibernias claim based on an instrument executed by Administracion Central Sociedad Anonima and endorsed by Granados as guarantor. Granados contends that the district court abused its discretion in refusing to set aside the summary judgment and consider appellants untimely filed response to Hibernias summary judgment motion. We agree and reverse.
